The possibility of expressing ourselves freely and manifesting our ideas is a necessary condition for advancing as a society. Since ancient times the right to freedom of expression has been a requirement and the fundamental condition for finding solutions to various problems.
It is closely linked to the right to information. This articulation seeks to guarantee the exercise of a whole system of rights and freedoms enshrined in most legal systems in the world, of which our country is no exception, such as the free manifestation of ideas, freedom of the press, freedom to disseminate information, freedom of artistic expression, and freedom of teaching and scientific research.
The importance of freedom of expression is beyond dispute. In contemporary society, it is a fundamental human right for the existence and development of a democracy.
There is a double dimension to freedom of expression: the individual, which is the right to express his or her thoughts freely, by any means and with the possibility of making his or her ideas known to the greatest number of recipients, and the social, a collective right to receive information and to know the expression of the thoughts of others.
It serves as a frontier to the exercise of power, acquires meaning in a social context, since it implies interaction, emphasizes the importance of the relations between the individual and the State, and delimits the competence of the latter.
It represents the axis of the preservation of public freedoms, that is, of other rights.
Therefore, States have the obligation to respect the manifestation of discontent and disagreement generated by the exercise of freedoms. No authority can apply inquisitorial procedures because they disagree with the ideas expressed.
In addition, the State must prevent acts and deeds that violate freedom of expression by promoting legal reforms, adopting public policies and implementing government measures aimed at establishing an effective pursuit of justice that generates social trust as a result of the fight against impunity.
In the Mexico of the second decade of the 21st century, it is clear that the responsibility to solve the various problems that society is going through will not be possible only with the performance of State institutions. It is necessary to obtain a greater social participation, so that public policies can be oriented to social needs and it does not turn out that sometimes social demands are one and government actions are oriented to opposite destinations, which instead of satisfying a legitimate demand of the population usually generate irritation.
Society, through its various forms of expression, is in a position to make the corresponding demands so that, through the analysis of the various points of view and the recognition of reality, the most certain solution can be found.
A peculiarity of modern democracies is that they have a heterogeneous culture and the possibility of dissenting, particularly, but not necessarily, exclusively with those in power. But dissent also presents limits, which are based on legitimacy, homogeneity and consensus, always in the search to remove selfish personal interest from the human being and to prioritize social or public interest.
To impose limitations to any of these freedoms through fear or intimidation, attempts against the development of democratic societies. It is an inadmissible restriction on the rights of every person, so the higher the democratic level reached by a country, the greater the freedom of expression of its population. It encourages people to be well informed, both by institutional and civil means, and thus to generate the conditions for achieving the ideals that we have envisioned in our project for the nation.
